These meetings play a crucial role in the legal process, helping parties gather information, clarify facts, and prepare for the next steps in a case. Understanding how EFDs work can save you time, reduce costs, and improve your overall case strategy.


What Are Examinations for Discovery?


Examinations for Discovery are meetings where the parties involved in litigation come together to discuss the case in detail. The goal is to:


  • Understand what happened

  • Review relevant background information

  • Identify missing documents

  • Ask questions to clarify facts


EFDs are not trials, they are an opportunity to learn that help both sides prepare for mediation, settlement talks, motions, or trial.


Why EFDs Matter in Litigation


EFDs are essential because they:


  • Help reveal the strengths and weaknesses of each party’s case

  • Help uncover documents that may not have been disclosed in the Affidavit of Documents (AOD), these become Undertakings, Under Advisements and Refusals.

  • Allow lawyers to ask targeted questions that clarify complex issues

  • Provide a chance to assess whether settlement is possible before costly trial proceedings


How the Affidavit of Documents Fits In


The Affidavit of Documents (AOD) is a sworn statement listing all documents relevant to the case. It serves as a foundation for EFDs by:

  • Highlighting gaps or missing files

  • Guiding the questions asked during the examination
