Understanding the 2025 Changes to Rule 1 of the Small Claims Court and the intended impact

Let's chat about Rule 1 of the Small Claims Court.
Last summer, Rule 1 of the Rules of Small Claims Court underwent significant changes that created elaboration on how cases are heard in Small Claims.
What Changed in Rule 1 of the Small Claims Court?
The first rule in the Rules of Small Claims Court was revised in 2025 to better define its purpose and the duties of the court. Here are the key updates:
Rule 1.03 (1) was General Principle and was one sentence regarding that the Rules should be liberally construed in accordance with Section 25 of the CJA.
Rule 1.03 (2) was Matters not Covered In Rules, and allowed the court to give direction (where appropriate) on the matter.
Rule 1.03 (1) is now called Primary Objective
Previously known as the General Principle, this section now clearly states the main goal of the rules. Instead of just saying the rules should be liberally construed, it emphasizes that the primary objective is to enable the court to deliver justice in a way that is fair, quick, and affordable.
Rule 1.03 (2) is now called Duty to Promote Primary Objective
This new subrule highlights the court’s responsibility to actively promote the primary objective. It clarifies that the court must interpret and apply the rules to support fair and efficient outcomes.
Rule 1.03 (3) is now Examples
To help everyone understand how the rules should be applied, this subrule provides specific examples of the goal of Small Claims. Being fair, being less expensive, procedures that align with the complexities of small claims (ie - being less complex).
Matters Not Covered became Rule 1.03.1
Why These Changes Matter
The Rule change put more emphasis on the purpose of the Small Claims Court Rules. The Rules allow the Court to determine cases more expeditiously and at a lower cost than in the Superior Court of Justice, and this new primary objective is working to ensure that the Small Claims Court continues to align with the notion that Small Claims is a more streamlined procedure. Essentially, the Rule is promoting accountability from the Court, counsel and parties.
Final Thoughts
The changes to Rule 1 of the Rules of Small Claims Court clarify the court’s mission and the responsibilities of all participants. By focusing on fairness, speed, and cost-effectiveness, the court aims to improve the experience for everyone involved.
