Understanding Court Monetary Caps in Ontario

Today, I want to talk with you about the current monetary caps for the Small Claims Court, Simplified Procedure, and the Regular Stream of the Superior Court of Justice, and why understanding Ontario court monetary caps matters.
Small Claims Court and Ontario Court Monetary Caps
The Small Claims Court limit is currently $50,000 (for the timing of the blog, this cap increase is brand new). When I began my career, it was $25,000. Interestingly, while there is no minimum amount to bring a claim, in my experience, I have rarely seen a Small Claims file for under $500.
Simplified Procedure
Simplified Procedure is for claims over $50,000 and under $200,000. Years ago, the cap was $100,000, but it has since doubled. This option is designed to make litigation more efficient by limiting procedures and encouraging cost-effective resolution.
Regular Stream
The Regular Stream applies to claims $200,000 and above. These cases tend to be more complex, involving multiple parties, higher stakes, and more intricate procedures.
My Experience and how it matters
Over the past 23 years, I have worked on files in all three streams—Small Claims, Simplified, and Regular Stream. This includes assisting with transferring files from one stream to another, from issuing a Claim in any of the three streams to securing a dismissal order. I have even clerked an Application becoming a Statement of Claim.
