Understanding Condominium Documents and Their Importance in Condo Living

Let's talk today about Condo Docs.

When you move your residence or business (or both) into a condominium, you enter a community governed by a set of important documents. These condominium documents, often (always) called condo docs, define how your building operates, how decisions are made, and what rules everyone must follow.

What Are Condominium Documents?

Condominium documents are the legal papers that establish and regulate a condo community. They explain how the condo is organized, how it manages itself, and what residents can expect. The main types of condo docs include:

• Descriptions

• Declarations

• Bylaws

Each plays a specific role in the condo’s management and daily life.

Descriptions and Declarations: Defining the Condo

The description sets out the condo’s geographical location and physical boundaries. It tells you exactly where the condo sits on the land registry and what land it covers.

The declaration is a key document that works with the description to officially create the condo in the land registry office. It includes:

• The corporate address of the condo corporation

• Details about common expense fees paid by owners

• Identification of common elements like hallways, elevators, and recreational areas

Together, the description and declaration form the foundation of the condo’s legal existence. They clarify what parts of the property are shared and what belongs to individual owners.

Bylaws: The Condo’s Administrative Guide

Bylaws are the condo’s internal rules for managing the community. They cover how the condo corporation operates and how decisions are made, what is considered legal and not. Some examples include:

• How many directors are needed on the condo board

• What constitutes a quorum for meetings

• Procedures for annual general meetings (AGMs)

• Policies on items like smoking, front porch flowers, and pets

  
  

Bylaws help keep the condo running smoothly by setting clear guidelines for governance. They ensure that everyone understands how the condo board functions and how owners can participate.

Rules: The Details of Daily Living

While bylaws cover governance, rules focus on everyday life in the condo. They provide specific instructions that affect residents’ behavior and use of common areas. Examples include:

• Size limits for pets

• Where visitors can park

• Quiet hours and noise restrictions

• Use of shared facilities like pools or gyms

  
  

Rules are designed to maintain harmony and safety in the community. They are usually easier to change than bylaws, allowing the condo to adapt to residents’ needs over time.
