Commissioning & Notarization: Why You Need a Trusted Ontario Legal Professional

Hi Everyone, it’s Kristy from Clearly Legal.


When it comes to legally binding documents proper authority make all the differences, and, in many cases, is legally required. Today, I would like to talk about the roles of Commissioners and Notary Publics, explain when you need each, and show why choosing someone with both credentials is a smart legal strategy.


What is a Commissioner?

A commissioner administers oaths and affirmations when someone must swear or affirm that information is true. Common uses include:

  • Affidavits and Affidavits of Documents

  • Exhibits for legal proceedings

  • Government documents, such as name changes

  • Law Society documentation for name changes


When you need to swear or affirm a fact, act or document is true, look for a commissioner (me!).


What is a Notary Public?

A Notary Public verifies the authenticity of signatures, marks, and documents. Examples include:

  • Certifying copies of official documents (birth certificates, transcripts)

  • Verifying signatures on legal forms and consent forms

  • Travel or guardianship consent letters


When you need to certify documents, signatures or travel solo with any child in your family, look for a Notary Public (me!).


Why Having Both Qualifications Matters

I hold both the Commissioner and Notary Public credentials. This means:

  • Convenience — One point of contact for both needs (hint - if you need to change your LSO name, you may need both a Commissioner and a Notary)

  • Accuracy — Proper compliance with legal requirements

  • Efficiency — No delays or need to seek separate professionals


It is important to note that you if believe you require substantive legal advice, or it is determined that you require substantive legal advice, and not just a seal or signature, you need to find a licensee. Not all Notaries and Commissioners are active lawyers and licensed paralegals.
